Who Are You?

Note: This page deals with US Lawsuits.

Facing lawsuits? I'm not being funny here. Knowing who you are is crucial.

Maybe I should say, Who are you in the eyes of the law? The answer might surprise you.

If you were aware of the impeachment procedings that were brought against former President Clinton when asked about his relationship with Monica Lewinsky, great jokes were made about his response to a prosecuters question.

He answered. "That depends on what 'is' is."

Clinton was a lawyer and in law 'is' can mean different things. He was asking for a precise definition. It's not as far-fetched as the non-legal newscasters played.

Are you ready for this legalease?

Okay. Here goes. I'm not a lawyer, but I have learned from some.

Are you the natural person? Or are you the NON-NATURAL PERSON or LEGAL FICTION. A CORPORATION, for example is LEGAL FICTION.. I'm not shouting when I use the all caps. It's a a legal way of differentiating natural and NON-NATURAL

Knowing this can make a great difference when involved with a lawsuit.

"In jurisprudence, a natural person is a human being perceptible through the senses and subject to physical laws, as opposed to an artificial, legal or juristic person, i.e., an organization that the law treats for some purposes as if it were a person distinct from its members or owner." From Wikipedia

John Jones is the natural person. JOHN JONES is the LEGAL FICTION.

Why is this important? CORPORATIONS and PERSONS, (i.e.LEGAL FICTIONS) fall under the jurisdiction of the courts, whereas the natural person is under the jurisdicion of Common Law.

Common Law, based on common sense, is a higher form of law than the Constitution or the Law of Government.

If you've ever go to court through a lawsuit and seen your name in all caps, you are there as a LEGAL FICTION.

To go to court and plead either guilty or not guilty, you will have agreed to be judged as a LEGAL FICTION and to accept the courts jurisdiction over you.

In such a case, you don't want to plead either. You want to question the jurisdiction. I'm simplifying this to give you a general idea of what you are up against.

Obviously, you'll need more education before you'd be prepared to step in front of a judge and question his/her authority over you in a lawsuit.

1776: The Declaration of Indpendence

By the time the Declaration was signed on July 4, the 13 colonies had already broken off from British and declared themselves separate nations.

The Declaration did two things: a) it put it in writing and b) declared a new sovereign. The King was no longer sovereign over anyone. In his place, the sovereign became "We the People," collectively, not individually.

"We the People" developed the "Articles of Confereation," which would unite the several states (former colonies) together for purspose of creating, armies, navies and generally protecting "We the People."

Later, the Constitution overrode the Articles. The Ariticles, the Consitution and the Government are all servants of "We the People."

Anyone, in any country, who looks at America today, sees that things have gotten a little upside down.

That's why, we need to educate ourselves and need to know our rights and protect them.

As sovereigns, we are not subject ot the Federal Government. That government is subjectto us.

I'm going to throw one more thing out here. The United States of America is a corporation -- that's right, AN ARTIFICAL PERSON or LEGAL FICTION. It is not the 50 states. It is The District of Columbia and the territories it governs. Citizens of the United States are individuals who were born or naturalized there.

If you live in any of the 50 states, you are not a citzen of The United States. Those of you in DC, I'm afraid you're stuck.

If I'm blowing your mind and you think I'm nuts, forgive and go on with your life.
